These Terms & Conditions explain the rules that apply when you visit PixelMarty, place an order, purchase physical or digital products, or use our custom design services. Please read them carefully before using our website or completing a purchase.
1. Acceptance of Terms
These Terms & Conditions govern your access to and use of the PixelMarty website, products, and services. By visiting our website, creating an account, placing an order, purchasing a digital product, or requesting a custom design, you confirm that you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy.
If you do not agree with these terms, please do not use our website or purchase our products and services.
2. Products and Services
PixelMarty offers physical products, print-on-demand merchandise, art and printed products, digital downloads, and custom design services. Product availability, colours, sizes, materials, features, prices, and delivery options may vary.
We make reasonable efforts to present product descriptions and images accurately. However, colours and visual details may appear slightly different depending on your device, screen settings, printing process, materials, and production method. Minor variations do not necessarily mean that a product is defective.
We may modify, discontinue, restrict, or update any product or service at any time. All products and services are subject to availability.
3. Orders and Payments
By placing an order, you confirm that the information you provide is accurate, complete, and current. You also confirm that you are authorized to use the selected payment method.
Submitting an order does not guarantee its acceptance. An order is accepted when we confirm it or begin processing or fulfilling it. We may cancel or refuse an order because of suspected fraud, payment failure, incorrect pricing, product unavailability, technical errors, prohibited content, or other reasonable circumstances.
Prices are displayed in the currency shown at checkout. Taxes, shipping charges, customs duties, currency-conversion fees, and other applicable charges may be added where required. You are responsible for reviewing the complete order total before payment.
Payments may be processed by third-party payment providers. PixelMarty does not directly store complete payment-card details. If a payment fails or is reversed, we may suspend or cancel the related order or service.
4. Print-on-Demand Products
Many PixelMarty physical products are created through print-on-demand production partners after an order is placed. Production may begin shortly after payment confirmation, so changes or cancellations may not always be possible once fulfilment has started.
Because products are individually printed, minor differences in colour, print placement, size, texture, or finish may occur. These normal production variations are not considered defects unless they materially affect the quality or intended use of the product.
Product mockups are provided to help illustrate the expected appearance. The finished product may vary slightly because of garment colour, fabric texture, printing method, available print area, or screen display settings.
If you receive an incorrect, damaged, or materially defective product, contact us promptly with your order number and clear photographs so that we can review the issue.
5. Digital Downloads
Digital products may include printable artwork, posters, templates, invitations, cards, stationery designs, marketing materials, or other downloadable files. No physical item will be shipped when a product is identified as a digital download.
Unless a product page states otherwise, purchasing a digital product gives you a limited, non-exclusive, non-transferable licence for personal use. You may download, store, and print the file for your own permitted use.
You may not resell, redistribute, share, sublicense, reproduce for commercial sale, upload to another platform, claim as your own work, or make the original or modified file available to others. Copyright and ownership remain with PixelMarty or the applicable rights holder.
You are responsible for checking the product description, file format, dimensions, software requirements, and intended use before purchasing. Printed colours and quality may vary depending on the printer, ink, paper, materials, and settings used.
Because digital products may be supplied immediately, cancellation or refund rights may be limited after download or access has begun, except where applicable law requires otherwise.
6. Custom Design Services
Custom design services may include personalized apparel graphics, accessory designs, digital designs, stationery, promotional materials, and other commissioned creative work. The project scope, price, estimated timeline, deliverables, and included revisions will be confirmed before or during the ordering process.
You are responsible for providing accurate instructions, correct spelling, suitable files, and timely feedback. Delays in providing information or approving work may extend the completion date.
Additional revisions, changes outside the agreed scope, premium assets, special formats, or urgent delivery may require an additional fee. Work may begin after payment or an agreed deposit is received.
You confirm that you have permission to use all names, photographs, logos, trademarks, text, artwork, and other materials you submit. PixelMarty may refuse content that is unlawful, infringing, hateful, abusive, deceptive, or otherwise inappropriate.
Unless agreed otherwise in writing, rights to the final approved design are granted only after full payment. Unused concepts, drafts, source materials, working files, and design methods remain the property of PixelMarty. Third-party fonts, photographs, graphics, or other licensed assets remain subject to their respective licence terms.
7. Shipping and Delivery
Physical products may be produced and shipped by PixelMarty or third-party fulfilment partners. Available shipping methods, estimated costs, and estimated delivery times will normally be displayed during checkout or communicated with the order.
Delivery estimates are not guaranteed unless expressly stated. Production or delivery may be delayed by high order volumes, holidays, weather, customs processing, carrier disruptions, incorrect address information, or other events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. Additional charges caused by an incorrect address, an unclaimed parcel, or a refused delivery may be the customer’s responsibility where permitted by law.
International orders may be subject to customs duties, import taxes, handling charges, or local fees. Unless otherwise stated, these charges are not included in the product or shipping price and are the customer’s responsibility.
Risk of loss and ownership of physical products transfer as provided by applicable law. If tracking shows a problem or your order does not arrive within a reasonable period, contact us so we can review the matter with the fulfilment partner or carrier.
8. Returns and Refunds
Returns, replacements, refunds, and cancellations are governed by our Return & Refund Policy and any mandatory consumer rights that apply to your purchase.
Because print-on-demand and personalized products are created specifically for each order, returns based only on a change of mind, an incorrect size selection, or customer-provided information may not be accepted where the law permits. Digital downloads and completed custom design services may also have restricted cancellation or refund eligibility after access, download, approval, or performance has begun.
If a physical product arrives damaged, materially defective, or different from the confirmed order, contact us promptly at support@pixelmarty.com. Include your order number, a description of the issue, and clear photographs of the product and packaging.
Do not return an item before receiving return instructions. Approved refunds will normally be sent to the original payment method. Processing times may vary depending on the payment provider.
Nothing in these Terms & Conditions limits any consumer rights that cannot legally be excluded or restricted.
9. Intellectual Property
The PixelMarty website and its content, including the brand name, logos, product designs, artwork, photographs, graphics, text, layouts, downloads, and other creative materials, are owned by or licensed to PixelMarty and are protected by applicable intellectual-property laws.
Except for the limited use expressly permitted with a purchased product, you may not copy, reproduce, modify, distribute, publish, display, sell, license, create derivative works from, or commercially exploit PixelMarty content without prior written permission.
Purchasing a product does not transfer copyright, trademark rights, or ownership of the underlying design or artwork unless a separate written agreement expressly states otherwise.
If you believe content on our website infringes your intellectual-property rights, contact support@pixelmarty.com with sufficient information for us to identify and review the material.
10. Prohibited Uses
You may use our website, products, and services only for lawful purposes. You must not use them to violate any law, infringe another person’s rights, distribute malicious software, interfere with website security, collect information without authorization, commit fraud, impersonate another person, or submit false or misleading information.
You must not copy or scrape website content, attempt to gain unauthorized access to our systems, misuse discount codes, interfere with checkout or payment systems, or use our products or services to create unlawful, infringing, hateful, abusive, or deceptive material.
We may restrict access, cancel orders, refuse custom-design requests, or suspend accounts when we reasonably believe these Terms & Conditions have been violated.
11. Limitation of Liability
To the fullest extent permitted by applicable law, PixelMarty will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of, or inability to use, our website, products, downloads, or services.
PixelMarty is not responsible for losses caused by customer-supplied errors, incompatible software, printing equipment, colour differences between screens and printed materials, misuse of products, third-party platforms, delivery-carrier disruptions, or events outside our reasonable control.
Where liability cannot legally be excluded, PixelMarty’s total liability relating to a particular order will be limited to the amount paid for that order, unless applicable law requires a different remedy or limit.
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded, including liability for fraud or other rights and remedies protected by mandatory consumer law.
12. Governing Law
These Terms & Conditions are governed by the laws applicable to PixelMarty’s legal place of establishment, without excluding any mandatory consumer protections available to you under the laws of your country or region.
Before starting formal proceedings, you and PixelMarty agree to make a reasonable effort to resolve any dispute by contacting the other party and explaining the issue.
Any dispute that cannot be resolved informally will be handled by the courts or dispute-resolution bodies having lawful jurisdiction. Nothing in this section prevents a consumer from using any mandatory rights or remedies available under applicable law.
13. Changes to These Terms
We may update these Terms & Conditions when our products, services, business practices, technologies, or legal obligations change.
The updated version will be posted on this page with a revised “Last updated” date. Unless otherwise stated, changes apply from the date they are published and do not retroactively alter terms already agreed for a completed purchase.
Your continued use of the website after an update means that you accept the revised terms. We encourage you to review this page periodically.
